Council’s Code of Meeting Practice allows for the Council to resolve itself into “committee of the whole” to avoid the necessity of limiting the number and duration of speeches as required by Clause 250 of the Local Government (General) Regulation 2005.
This item enables councillors to call any item they wish to be debated in “committee of the whole” at the conclusion of normal business.
The debate process during a ‘normal’ Council meeting limits the number and duration of speeches as required by Clause 250 of the Local Government (General) Regulation 2005.
Items should only be called at this time if it is expected that discussion beyond the normal debate process is likely to be needed.

General Manager's REPORT
Regional Development Australia (RDA) Central West are seeking financial support to help continue the delivery of the Ten4Ten Leadership Dialogue. The program aims to connect ten select Year 11 students with ten local community leaders for a unique mentoring experience.
The core of the program is skills development and fostering civic pride.
Last year, students from Cabonne, Orange and Blayney were given the opportunity to be mentored by ten leaders from various sectors of the community and discover what career opportunities are available in the region.
RDA request support of $1,500 (plus GST) from council. Sponsorship will include council’s logo on all correspondence, promotion material and media release as well as recognition as a sponsor of the program at all events.

General Manager's REPORT
The 30th annual NSW Rural Women’s Gathering, hosted by the Australian National Field Days with support from the NSW Government and Rural Women’s Network, will be held on 25-27 August 2023.
The NSW Rural Women’s Network is a statewide government program of Women NSW located in the NSW Department of Premier and Cabinet.
The event aims to:
· Provide an opportunity for rural women to connect, share experiences, and support each other through good and tough times,
· Provide opportunities for rural women to have a direct voice to decision makers through Government, Ministers and other decision makers attending the event and through the distribution of a post event issues/ideas ‘Statement’,
· Enable rural women to access information on existing services, resources, and assistance,
· Provide an opportunity for rural women to learn from listening to inspiring and informative speakers, display stands and participating in a range of workshops,
· Raise the profile of rural women and highlight important issues through wide media coverage, and
· Be inclusive by involving women from Aboriginal and culturally & linguistically diverse backgrounds and younger women as participants and on organising committees wherever possible.
The cost per delegate to attend is $250.

THAT Council:
1. Apply for funding through round one of the Federal Government’s Growing Regions Program to fund the following projects:
a. Molong multipurpose recreation precinct valued at approximately $5.3m, b. Activation project at Memorial Park, Eugowra valued at approximately $1.13m, c. Rebuild and restoration of Canowindra and Cudal pedestrian bridges valued at approximately $2.67m, d. Restoration of lighting at Eugowra Sports Ground valued at approximately $850,000, e. Refurbishment of sport and recreation facilities at Manildra valued at approximately $800,000, and f. Activation of Eugowra CBD valued at approximately $1.55m.
2. Agree to provide a 10% co-contribution of $1.23m to be taken from council’s insurance payout from the November 2022 floods.

Leader - Community and Economy REPORT
BACKGROUND
The Growing Regions Program provides grants of between $500,000 and $15 million to local government and not-for-profit organisations, for capital works projects that deliver community and economic infrastructure projects across regional and rural Australia.
The program is open competitive with grants awarded on a merit basis.
There is a two-stage application process. Under Stage One, applicants are required to submit Expressions of Interest which will be assessed to ensure projects meet eligibility requirements, project readiness and program suitability, and are aligned with regional priorities for the area.
Expressions of Interest that are assessed as meeting requirements and approved to proceed will then be invited to submit a full application (Stage Two).
PROGRAM OBJECTIVE
The objectives of the Growing Regions Program are:
· Constructing or upgrading infrastructure that fills an identified gap or need for community infrastructure.
· Contributing to achieving a wide range of community socio-economic outcomes.
FUNDING CRITERIA
Organisations are required to contribute towards their projects. Co-funding requirements are:

Under this requirement, Cabonne Council falls into Group 1. Council must provide evidence to support the request for the 90 per cent co-funding from the Commonwealth.
All co-contributions to projects must be cash.

Council has received one application under the 2023/2024 Events Assistance Program (EAP). Council’s Tourism, Culture & Events Coordinator has provided the following assessment.

Australian National Field Days
NSW Rural Women’s Gathering 2023
Requested: $2,000

The Australian National Field Days (ANFD) is hosting the NSW Rural Women’s Gathering at the Borenore site on 25-27 August 2023.
The annual event held in different locations each year is supported by the NSW Government and Rural Women’s Network.
The gathering will attract 300 women from across NSW to the region to provide an opportunity for rural women to connect, share experiences, support and learn. The event includes speakers, display stands and hands-on workshops to provide attendees information on existing services, resources, assistance and networks.
The program includes events at two Orange businesses (registration at Oriana Motel and event dinner at Orange Ex-Services Club) with the rest of the program held at the ANFD site. Local business opportunities are also created through promotion of local people and products, in addition to accommodation for attendees.
If funding is approved, council will receive the following benefits:
· Naming Rights of morning tea event (held Saturday, 26 August 2023)
· Logo on Website
· Logo on program
· Banner displayed during gathering.
· Social Media Posts
· 2 tickets to Gathering Dinner – Saturday, 26 August 2023
Under the guidelines of the EAP this fits the criteria as a Flagship Event (not a Core Event as per the application), thus the recommendation.
The 2023/24 EAP budget is $40,000 to date $0 has been allocated.
This report and recommendations have not been able to be put before the Cabonne Community, Economy, and Culture Committee due to the timing.

Council has received correspondence from the Australian Local Government Association (ALGA) calling for council’s interest for attendance at the 2023 National Local Roads, Transport & Infrastructure Congress.
2023 National Local Roads, Transport & Infrastructure Congress
ALGA will be holding their annual National Local Roads, Transport & Infrastructure Congress at Kambri Cultural Centre, ANU, Canberra on Tuesday 5 September 2023 to Thursday 7 September 2023.
The theme of this year’s congress is “Building communities that are safer, stronger, smarter”. The Cabonne Floodplain Advisory Committee Meeting was held on 29 June 2023. At the meeting the following items were considered with recommendations to council for consideration:
Molong Flood Study and Management Plan Review Update
Lyall and Associates provided a presentation which included the draft modelling of flood behaviour for the Molong 2022 flood event. Further refinement is required for the model. Modelling is due for completion in December 2023, and the Floodplain Risk Management Plan due in March 2024.
Puzzle Flat Creek Levee Flood Modelling
Manly Hydraulics Laboratory provided a presentation on the draft Puzzle Flat Creek Levee Flooding Modelling. The report seeks to provide indication of the Eugowra Floodplain behaviour following the completion of the Puzzle Flat Creek Levee.
The report is still in draft and will be presented to the next Cabonne Floodplain Management Advisory Committee.

The Cabonne Local Traffic Committee Meeting was held on 6 July 2023. At the meeting the following items were considered with recommendations to council for consideration.
Concealed Driveway Sign
The committee’s recommendation was “That the Committee table this report for a future meeting so that a full investigation can be undertaken”.
Signage – Horse and Livestock
The committee’s recommendation was “That the committee note the submission with regards to horse and livestock safety and refer the submission to the Orange and Cabonne Road Safety Committee”.
The committee’s recommendation considered that consideration of speed zone changes within the Mullion Creek township may assist with horse/pedestrian safety. Given the breadth of the request, it was thought appropriate for the Orange and Cabonne Road Safety Committee to consider a program of awareness for the community.
Speed Limit Review on Long Point Road Mullion Creek
The committee’s recommendation was “That the Local Traffic Committee request Transport for NSW to consider the extension of the Mullion Creek speed zone on Long Point Road”.
Discussion during the committee meeting indicated that a review for the school zone was currently being considered, and the review of the speed zone would be an extension of the current review.
Proposed Orange Cycle Club Event
The committee’s recommendation was “That the Local Traffic Committee delay consideration of the event and request further information from AusCycling & Orange Cycle Club Event regarding the event to be held in March 2024”.
Speed Limit Review – Cumnock Urban Area
The committee’s recommendation was:
“1. That the Road Safety Officer undertake a speed awareness campaign for the Cumnock urban area to encourage observance of the urban speed zone and,
2. Request the NSW Police Force – Highway Patrol to increase patrols of the Cumnock township”.
Assessment of traffic count information found a speed issue; however, the position of the current urban speed zone signage was appropriately located. It was the opinion of the committee that targeted speed awareness campaign would be a favorable option, along with increased NSW Police Force – Highway Patrol presence in Cumnock.
Speed Limit Review – Cargo Road, Cargo
The committee’s recommendation was:
“1. That the Local Traffic Committee request Transport for NSW to undertake a speed zone review for the Cargo township on Cargo Road, and
2. Install a Reduce Speed (ge9-3) sign approaching Cargo in the vicinity of the Cargo Urban Speed Zone on Cargo Road (west)”.
Consideration was given to the location of the urban speed zone signage and the locality of the end of the overtaking lane from Canowindra. A speed zone assessment was considered warranted and will include consideration of a transition speed zone of 80km/hr into Cargo to allow for greater deceleration to occur.

Deputy General Manager - Cabonne Infrastructure's REPORT
Cabonne Council is responsible for the management of over $437m in transport assets across a road network of 1,993km. To ensure that the services provided are efficient, effective and sustainable, it is essential that council defines the extent of the road network to which it manages.
A Roads Management Policy provides direction and guidance to the extent of road administration and maintenance undertaken for the Cabonne Council road network as prescribed within the Roads Act 1993.
The objectives of this policy are to define:
a) Extent of the road network managed by council
b) Under its authority, the administration and management of public roads
c) Framework for determining the expansion of road network managed by council
A key focus of the policy is the keeping of a Cabonne Council Roads Register. This roads register is kept to define the extent of road network that council actively maintains and manages. The road register will contain information which can be utilised to determine the full length of roads maintained and will provide the basis for determining future road works including operational, maintenance and capital upgrades.
Roads that are not contained within the road register are not actively managed or maintained by council and will not be actively managed or funded.
An agreement may be entered into with private parties to undertake work within the road reserve, at the cost of the private parties. This includes the provision of driveway access to properties which do not have direct access to the local road network.
A party may request council to include a road within the road register by making an application in writing to council. Requests will be considered against the following criteria:
· Number of residents per kilometre of road
· Estimated traffic volume
· General public use, including recreation and emergency use
· Lifecycle cost of maintaining the asset
· Overall public interest for council to maintain the road
· Other relevant information
Cabonne Council may request the applicant to upgrade the road in accordance with council current standards for the proposed road classification.
Should Council endorse the draft, the policy will be placed on public exhibition for 28 days. Following this period, the draft policy will be brought to a future Council meeting for consideration.

Department Leader - Finance's REPORT
Council’s investments as 30 June 2023 stand at a total of $32,205,894.27.
Council’s average interest rate as of 30 June 2023 was 4.22%. The effect of the increased cash rate is starting to have a positive impact on term deposit rates offered by financial institutions. The Reserve Bank’s official cash rate increased to 4.1% during the month of June 2023. Council’s Performance Benchmark is the 30 Day Bank Bill Swap Rate and council is currently performing above the June 2023 Performance Benchmark of 4.1440%.
Council had two Term Deposit maturities during June 2023, both were re-invested in their current financial institutions, the $3m Westpac Business Bank maturity that was redeemed so that it could be re-invested was placed in the CBA Business Online Saver account.
Shorter reinvestment terms are being selected as it is anticipated that rates may increase again. This can be noted with the steady increase in interest rates on all new reinvestments and the RBA interest rate increase at the beginning of June 2023.
Council’s investments are held with multiple Australian financial Institutions with varying credit ratings according to council’s Investment Policy. The annexure to this report shows a breakup of each individual institution that council invests with and its “Standard and Poor’s” Credit Rating.
The Schedule of Investments for June 2023 is attached for council’s information.

Council adopted guidelines for the Community Facilitation Fund (CFF) in March 2015. The CFF was created for smaller community projects not originally included in the council’s budget, to be allocated at the discretion of the Mayor and Deputy Mayor.
As a reminder, the guidelines for the CFF are as follows:
1. Projects where no existing vote for the works has been allocated or the vote is insufficient to complete the project.
2. Recipients must be community based not-for-profit groups.
3. Mayor and Deputy Mayor to jointly approve funds (with the General Manager as proxy if one is not available).
4. Allocation of funds to be reported to the next available council meeting.

RECOVERY THEME 1: RESTORE COUNCIL’S INFRASTRUCTURE
Council’s role: Advocacy and Delivery
Council's roads crew have undertaken $12.7m (to date) in repair road following the damage from the November 2022 flood event.
This includes:

· Council is currently undertaking temporary sealing works in various areas around Cabonne to combat the road damage due to the continuous wet weather over the past few months. Further works will be completed on the roads in coming months once weather conditions improve. The temporary works will occur on sections of:

o Warraderry Way
o Mousehole Lane
o Nangar Rd
· Four-Mile Creek landslip tender has closed and is currently being reviewed by Transport for NSW regarding funding.
· Council staff and UGL Regional Linx have reviewed the damage to the old rail line and bridge at Canowindra. UGL Regional Linx has committed to removing 1.3kms of damaged rail line but is awaiting Transport for NSW to approve the works. The works include the removal of both rail bridges and the embankment between them.
· Council has undertaken further reviews of the approaches to the Nyrang Creek Bridge sidetrack. To further slow traffic on the approaches, council have installed several rumple strips.
· Bridge engineers have undertaken assessments of Nyrang Creek Bridge, Canomodine Lane Bridge, Manildra footbridge and Cudal Swinging Bridge. Council has received the Nyrang Creek Bridge report and is reviewing the recommendations in conjunction with Transport for NSW. Further bridge reports are due to be received in August.
· Council is also awaiting reports from bridge engineers for Pinecliffe Road culvert, Norah Creek Road culvert, and Coates Creek bridge. These will then be presented to Transport for NSW for funding opportunities.
· Road engineer contractors are currently reviewing several roads across Cabonne that were extensively damaged in the November 2022 flood event. They will be providing a report to council in August. These will also be reviewed by Transport for NSW for funding options.
Council staff have also completed the following community infrastructure works:
· Consultation has been completed with the Molong Recreation Ground users regarding the perimeter fence. Work on the new fence is due to commence shortly.
· Council will be commencing work to replace the fence along the creek at Jack Huxley Oval, Manildra.
· Restoration of the lighting has been completed at Jack Huxley Oval, Manildra.
· Council has undertaken some minor repair works at Apex Park in Eugowra in preparation for the Woodfired event in early August.
· Plans of Management for the Molong, Cudal, and Eugowra Showgrounds are currently being prepared following stakeholder meetings, with the Masterplan for the Showground to be undertaken following completion. Further consultation with key stakeholders will be undertaken to develop the Masterplans.
· The tender for the rebuilding of the Eugowra Self-Care Units closed in July, with council considering this at the July meeting.
· The work at the Eugowra Medical Centre has been completed. An official opening is currently being discussed with the Eugowra Medical Centre Committee.
RECOVERY THEME 2: SUPPORT COMMUNITIES TO RECOVER & REBUILD
Council’s role: Advocacy, Facilitation, and Delivery
Council formally adopted the Cabonne Recovery Plan at its June 2023 council meeting. The Recovery Plan is now our roadmap to recovery and has been very well received by Federal and State MPs and government agencies.
Following the floods in November 2022, the council has been working with the NSW Education Department (School Infrastructure), Reconstruction NSW and the community to reinstate a fit for purpose temporary early childhood center for the community of Eugowra.
The Eugowra Community Children’s Centre (ECCC) has currently been operating from the Eugowra Public School, at a reduced capacity.
To expedite the re-establishment of the ECCC at full licensed capacity, council has agreed to take custody of the temporary facilities that were installed at the Eugowra Showground by the Department of Education (School Infrastructure).
This includes management of the lease agreement with the Department of Education, as well as the licensing and commissioning of the buildings for use by the ECCC as a community facility (pre school).
A lease was signed by the General Manager of Cabonne on 1 June 2023, with a subsequent Development Application for the temporary land use currently on public exhibition until 20 July 2023.
Council is continuing to provide support to the ECCC committee and staff in seeking funding for the re-establishment of the ECCC at a permanent site.
RECOVERY THEME 3: SUPPORT BUSINESS & REGIONAL ECONOMY
Council’s role: Advocacy and Facilitation
Work is continuing on the activation projects for the Molong and Canowindra main streets.
Council staff are supporting the Eugowra Events and Tourism Association (EETA) with the Woodfired Event due to be held on Saturday, 5 August 2023. This event will bring over 700 people to Eugowra and will feature a camp oven cooking competition, woodfired pizza, slow-cooked and smoked meats, sweet and savoury crepes, and a billy boiling competition.
RECOVERY THEME 4: ENVIRONMENTAL RESTORATION & ADAPTATION
Council’s role: Advocacy, Facilitation and Delivery
Council staff are continuing to support work by the Environment Protection Authority (EPA) and Avcon as they clear large flood debris from waterways in Eugowra, Cudal and Molong. This includes the removal of hazardous materials.
