Council’s Code of Meeting Practice allows for the Council to resolve itself into “committee of the whole” to avoid the necessity of limiting the number and duration of speeches as required by Clause 250 of the Local Government (General) Regulation 2005.

 

This item enables councillors to call any item they wish to be debated in “committee of the whole” at the conclusion of normal business.

 

The debate process during a ‘normal’ Council meeting limits the number and duration of speeches as required by Clause 250 of the Local Government (General) Regulation 2005. 

 

Items should only be called at this time if it is expected that discussion beyond the normal debate process is likely to be needed.

Recommendation

 

THAT Council contribute $387.77 towards assistance with legal costs incurred in relation to Cowra Shire Council.

 

Administration Officer's REPORT

 

Council will be aware of the Local Government NSW (LGNSW) Legal Assistance Policy which allows a council to apply for the support of the Association in seeking contributions from all councils to assist with its legal costs where that council is involved in litigation and the principle in question in the matter:

 

·    involves a major local government principle which may be eroded but for pursuing the matter; and

 

·    is one which should not be eroded merely because the council involved is not itself, so seriously affected by the outcome of the case that the legal costs associated with pursuing the principle outweigh any other consequences.  That is, just because the council involved itself, has decided in all the circumstances not to further pursue the matter, legal assistance can be provided where the matter is of such significance and broader concern to the whole of local government to warrant pursuing the principle.

 

On 23 February 2016, council was advised that the LGNSW Board approved an application made by Cowra Shire Council for legal assistance to defend an appeal matter under the LGNSW Legal Assistance Policy & Guidelines.  The LGNSW Board considered this matter to be of importance to all local governments throughout NSW as the appeal relates to the interpretation of councils' powers under the Local Government Act NSW (the Act) and councils' ability to rely on the Act to issue notices and orders where animal welfare issues are not covered by other laws.

 

The Land and Environment Court has agreed that councils should be able to issue orders under section 124 of the Act and the judgment can be viewed via that Court's website — the citation is McCudden v Cowra Shire Council [2016] NSWLEC 14.  Click here for link.

 

Financial contributions are now being sought from councils as the Land and Environment Court has resolved this matter and the costs of the proceedings have been determined.

 

The requested amount from Cabonne Council in this matter is $387.77. 

 

Councillors are reminded that there is no obligation for a council to provide assistance however it has been past practice to do so.

Council has been requested by our solicitors, Messenger & Messenger to affix the common seal to the documents associated with the purchase of the land known as Lot 1182 in an unregistered plan of acquisition DP 1179438, currently registered comprising Part Lot 2 DP 109486.

Cabonne Council purchased the leased land from Transport for NSW for the construction of a road bridge over railway line near Nashdale on Cargo Road. Messenger & Messenger is in the process of formalising the purchase of the leased land giving council title of the land currently acquired by Council for Cargo Road deviation at Ingham Bridge.

Acting Technical Services Manager's REPORT

 

Council held an Electronic Traffic Committee meeting 9-11 August. The minutes from the meeting are attached.

The committee made the following recommendation:

E-LTC ITEM 1 – Orange Highlands Pinnacle Peaks Gran Fondo

THAT Council approve the request subject to:

1.   Implementation of the Risk Management Plan and Traffic Management Plan, in accordance with the “Guide to Traffic and Transport Management for Special Events” (RTA, v3.4 August 2006) for a Class 2 event:

a.   Update of the submitted TMP with the change to the Traffic Control Plan and signage locations as per advice to Council.

2.   NSW Road Rules being observed by participants at all times.

3.   Written approval being obtained from NSW Police.

4.   Written approval being obtained from all affected Local Government Authorities.

5.   Council being provided with an updated copy of the $20M Public Liability Insurance Policy indicating Cabonne Council’s interests, with the date and location of the event.

6.   The event organiser notifying all emergency services of the event.

7.   The event organiser notify Council of any incidents or near misses that occur during the event.

 

ITEM 11 - EUGOWRA VOLUNTARY PURCHASE

THAT:

1.  Council apply for funding from the NSW Office of Environment and Heritage (OEH) for the voluntary purchase of 14 Cooper Street, Eugowra.

2.  A second report be submitted to Council advising of the outcome of the proposed funding application prior to commencement of acquisition.  

 

Urban Assets Coordinator's REPORT

 

Council at its ordinary meeting of 26 May 2016 confirmed a property at 14 Cooper Street, Eugowra as the next acquisition under the voluntary purchase policy.   The owner of the property wishes to sell to Council and has accepted the independent valuation of $145,000.

 

Council staff have liased with the Eugowra Consultative Committee who have no objection to the proposed purchase of the property and demolition of the dwelling. Council staff have liaised with the NSW Office of Environment and Heritage (OEH) who has informally advised that funding may be available for the voluntary purchase in 2016/17. 

 

The estimated total cost of the purchase, demolition and legal costs are estimated at $195,000. Council would expect to receive 2/3 reimbursement from OEH estimated at $130,000. Council’s budget for voluntary purchase for 2016/17 is $327,796.

 

Following consultation with the Eugowra community and no objection being raised to the proposed voluntary purchase Council is now in a position to apply to OEH for funding.

Recommendation

 

THAT:

 

1.    Council approve the annual Picnic Day to be held on Friday 14 October 2016.

2.    Council authorise the attendance of all councillors at the Picnic Day.

3.    Councillors note the cost of $52.00 for attending the Picnic Day to be paid to the Picnic Committee from the Councillor Expense Account.

 

Acting General Manager's REPORT

 

Council has received a request from the staff Picnic Committee, seeking Council’s consent to hold the annual Council picnic day on Friday 14 October 2016.

 

Council has always supported the conduct of the Council picnic day for all staff members, and a continuation of this practice is supported.

 

The usual practice for the conduct of the picnic is to make the picnic available for all staff who purchase a picnic ticket and attend on the day.   Staff who do not participate in the picnic day have the option to take annual leave or a rostered day off, as appropriate.

 

This year’s picnic will be held in Yeoval.  The day will consist of golf, tennis, bowls and lunch.  The cost of attending the picnic day is $52.00 which covers the cost of activities, lunch and refreshments.

 

Councillors are welcome to attend and should notify the General Manager if they wish to do so.

Community Services Manager's REPORT

 

Cumnock Progress Association

Members of the Cumnock Progress Association have created a website to honour Boer War and WW1 veterans from the district.  The website will feature the profiles approximately 120 veterans from WW1 and 15 from the Boer War. 

 

They hope that this website will be useful to relatives of the servicemen in researching family history and to promote the town of Cumnock to a wider audience. 

 

This is a worthwhile project and particularly relevant given the centenary of the first world war.  A $300 donation would be of considerable help to the committee.

 

Cudal Public School

Some of the students at Cudal Public School were captivated by a robotics demonstration on a recent excursion to Sydney and as a way to improve learning outcomes for the students the school is looking to purchase some robotic kits for the students to work with. 

 

The school believes that robotics is a great way to incorporate STEM (Science, Technology, Engineering and Mathematics) into learning experiences and a really effective way to engage students in all areas of learning. 

 

This will link well with the introduction of a “Kids as Teachers” program and will enable students to invite parents and community members in to demonstrate and teach them how to use robotics. 

 

The purchase of a class set (enough for 8 students) of robotics will cost $2,699.91 and the school has indicated that it will value any contribution made by Council. 

 

Robotics is an area of study that connects well with the curriculum and is likely to enthuse the students at Cudal. 

 

The issue in giving a donation is that several other schools in Cabonne including Mullion Creek and Cargo have purchased robotics resources without assistance from Council and it is likely that more Cabonne schools will wish to include robotics into their curriculum.  

 

Nashdale Parents and Citizens

Nashdale Parents and Citizens have applied for a Foundation for Regional and Rural Renewal (FRRR) “ANZ Seeds of Renewal” grant worth $15,000, closing on the 26 August 2016.

 

They seek the funding to assist with the purchase of a range of information technology equipment to set up an “Apple Classroom”, which is claimed to be a highly effective and simple method of delivering ‘digital literacy’ education to primary school students. 

 

The total value of the equipment is $21,600.  With an in-kind contribution from Leading Edge Computers and a contribution from the P&C they are able to fund 18 of the 20 iPads.  If the school can order an extra two iPads, they will qualify for an educational discount.  

 

Nashdale P & C has asked if Council could fund the remaining two iPads at a cost of $1,460, if the grant application is successful

 

A Council contribution to the purchase of equipment will give Nashdale P&C’s grant application a greater chance of being successful. 

 

A $500 donation would assist the school.

 

Should Council wish to make a donation there is $8,390 in Council’s budget for donations and this has not yet been drawn upon this financial year.

Senior Rates Officer's REPORT

 

A letter has been received from Acacia Lodge Management Committee requesting a donation towards rates for various properties.

 

The Boree Lodge property at Cudal, A30857, had previously been granted a donation of the general rate, however this was done under a different process where Council would pay the rates in full and issue an account for rates less the general rate.

 

The donation had not been made for the 2015/2016 rating year due to the change in procedures.

 

The account is now issued directly to the Committee who now request the donation of the general rates.

THAT Council:

 

1.   Ratifies the draft Marketing and Communication Plan for the Age of Fishes Museum, Canowindra.

2.   Authorises the Acting Economic Development Manager to implement the Marketing and Communication Plan in consultation with the Age of Fishes Board and Museum Manager.

 

ACTING ECONOMIC DEVELOPMENT MANAGER'S REPORT

 

In its 2016-17 Budget, Council provided a one-off allocation of $50,000 to fund a marketing campaign for the Age of Fishes Museum at Canowindra. The campaign is to include a component to promote the Canowindra area as a whole. With the deduction of the 15% overhead allocation, $43,478 of expenditure is available.

 

Following several meetings, the Age of Fishes board has developed a draft Marketing and Communications Plan with the expert assistance of board member Caddie Marshall, the principal of the Adloyalty marketing agency at Canowindra.  Ms Marshall donated her services free of charge to the board.

 

The primary objectives are:

 

1.   Increase visitation of the Age of Fishes Museum to 16,000 visitors per annum.

2.   Raise the profile of the museum and Canowindra.

3.   Increase the intrinsic value of the Age of Fishes Museum within the community, the scientific fraternity and regional tourism industry.

 

The plan incorporates the following five marketing strategies and tactics:

 

Marketing Strategy #1

 

Position the Age of Fishes Museum as the Central West’s “must see” destination based on the “birthplace of evolution”.

 

Tactics:

1   Develop a Tactical Marketing & Communication Plan including Direct Marketing, Social Media and traditional Media

·    Introduce the tagline/call to action “Visit the Birthplace of Evolution” across all marketing.

Event Description:

 

The Canowindra Balloon Challenge is a week-long competitive ballooning event with an aim to offer world class balloon competition and attractions to tourists.  Additional activities conducted during the week include Balloon Glow Spectacular, Family Friendly Food and Wine, variety of market stalls and a Rugby Match. 

 

Canowindra Challenge Inc.  have future plans to develop and extend the sustainability of this significant event with additional attractions.  A new addition will be the opening ceremony which will be a public ticketed event with entertainment.

 

The 2016 Canowindra Balloon Challenge is a major spectator event, that attracted 17 balloons from Australia, America and Canada with approximately 8,000 visitors to the town and a reported to $1.5 Million injection into the economy.   

 

Due to the tri-annual funding from Destination NSW and the continued support of Cabonne Council the 2016 event was able to recover from the debt incurred from the heavy rain that caused the 2015 event to be a wash out.  The community organisation now is in a strong financial position debt free with $24,000 in the bank and strong future plans for continued development that will add value to this signature Cabonne event.

 

Canowindra Challenge Inc.  Chair Graham Kerr and Secretary Jan Kerr delivered an informative presentation to Council on the 26 July 2016.  Outlining the committee’s future plans, new initiatives and commitments to increase improved recruitment from community and industry members to become actively involved in the planning and management of this valuable event. 

 

The Canowindra Balloon Challenge 2016 was recently nominated as a finalist in the Regional Tourist Awards held in Echuca Moama and were winners on the night receiving a Bronze award in the Community Festivals and Events Category. 

 

The Canowindra Balloon Challenge event will:

 

·    Place Council’s logo on all promotional material.

·    Increase visitors to the region.

·    Increase visitor spend in the region.

·    Raise awareness and enhance the region’s profile and its many attractions to the visitors.

 

Assessment

 

The submitted application meets the grant criteria of the Events Assistance Program as a flagship event that will attract visitors to Cabonne and make a significant contribution to the regional economy. 

 

In 2016 Council allocated $20,000 to support the Canowindra Balloon Challenge.

Event Description:

 

Cycling NSW held the State Championship for Master Cyclists in Molong and Orange in April 2016. 

 

The cycling event attracted 460 entrants from all parts of NSW and a number of interstate riders.  These cyclists brought with them family members, officials and support members. 

 

The break-up of the 460 entries consisted of:

Road Race:                 424 entries

Criterium:                    292 entries

Time Trial:                             166 entries

 

The Masters Road Race is scheduled to be held in Molong with the Time Trial and Criterium in Orange.  The NSW Masters Road Cycling Championship is held over three days and provides an opportunity to showcase the many attractions and assets of the area.  Our local businesses and accommodation outlets reported an increase in visitors and spend in the area.

 

Molong and surrounding area enjoyed hosting the road race.  Overall community feedback was extremely positive and highly supportive of this NSW Championship and the example of a healthy lifestyle activity.

 

As the event is a State Championship, the largest of Cycling NSW’s annual championships, hosting the event attracted extensive media coverage, strong community spectator interest and attendance at the event and a notable increase in visitation and spend in our area.  Hosting this event definitely showcased our many attractions to the visitors and competitors, the positive experiences in turn helps to generate return visitation and increased awareness of the region.

 

Assessment

 

The submitted application from Cycling NSW meets the grant criteria of the Events Assistance Program as a flagship event that will attract visitors to Cabonne and make a significant contribution to the regional economy. 

 

In 2016 Council allocated $5,000 to support the Cycling NSW Master Cycling Road Race held in Molong.

Event Description:

 

Canowindra @ Home have held the Airing of the Quilts for the last four years on the October long week-end.  The committee have developed a walking trail around Canowindra for visitors and community members to view the quilts that are draped over many of the shop windows.  This provides an opportunity for visitors to view Canowindra’s many attractions.  The window displays and Airing of the Quilts will take place a week prior to the October long weekend. 

 

To add a variety of attractions the committee have invited quilters from surrounding villages to participate.  The event also coincides with Charlie McCarron’s Holden Cars auction that is managed by Burns Auctioneers and is reported to attract between 4,000 to 5,000 people over the long weekend.  The committee and auctioneers are working together to ensure the weekend runs smoothly and is a success.

 

The committee has organised wine and food stalls in Memorial Park, the viewing of films and an art exhibition along with the packaging of accommodation and attractions to add a variety of activities and experiences to cater to the many diverse community interests. 

 

The Airing of the Quilts event will:

 

·    Place Council’s logo on all promotional material

·    Increase visitors to the area

·    Increase visitor spend in the town

·    Raise awareness and enhance the profile of the region and its many attractions

 

Assessment

 

The submitted application from Canowindra@home for Airing the Quilts meets the grant criteria of the Events Assistance Program as a developing event to attract visitors to Cabonne and make a significant contribution to the town’s economy. 

 

The committee requested $5,705 for funding support.  It is recommend that $2,000 be considered for marketing initiatives and that this amount include the hire of a skip bin for the event.

THAT Council amend the policy of allowing residential connections to the Molong Water Supply Scheme as follows:

That no new water main extensions or connection to the Molong Water Supply Scheme are to be authorised outside the village zone except for;

1.   the north side of South Street between George Street and Peabody Road

2.   Molong to Cumnock and Yeoval potable water pipeline subject to such connections not adversely affecting the supply to Cumnock and Yeoval villages

Acting Director of Engineering & Technical Services' REPORT

Council has received a number of informal enquiries concerning access to the proposed potable water main that is to be installed in the Banjo Paterson Way road reserve connecting Molong to Cumnock and Yeoval.

It is considered timely that prior to the pipeline being constructed Council develop a policy concerning such connections.

Background

Council has let the contract for the design of the Molong to Cumnock and Yeoval pipeline and it is proposed to include in the design sufficient capacity to meet the likely needs of these towns and possible extensions beyond.

As the pipeline is to meet demand for the next 50 years it is proposed to install a minimum size of 150mm diameter main which will be approximately double the anticipated design capacity requirement.

DPI Water are supportive of this approach as it also provides the opportunity for further regional water connections. 

Proposal

The pipeline provides Council with an opportunity to provide potable water connections to residents outside of the villages and there are no engineering constrictions in providing this service.  There are approximately twenty residences within a reasonable distance of Banjo Paterson Way that may take advantage of this service.

Customer charges could be similar to other water users with an access charge and separate usage charge but Council could defer a decision as to the quantum of such charges until after the pipeline is completed. 

Council currently has a policy regarding connections to the Molong Water Supply scheme as follows:

Council has a standing resolution to have a delegate or delegates attend the annual National Local Roads and Transport Congress.  The Roads Congress will be an important opportunity to engage with the Government on how its policies will impact on the provision and maintenance of local roads as well as the broader infrastructure and transport agenda.  The Congress will feature national and international speakers and an invitation has gone out to the relevant Government and Opposition representatives. 

Cabonne’s delegation in previous years has included the Mayor (or alternate) and the Director of Engineering and Technical Services (DETS).  This year we would send an alternate person to attend in the Director’s place.

Urban Assets Coordinator's REPORT

Council recently assisted the Canowindra community to form a new S355 committee for the management of the Orana House building.  Orana House is the only community centre in Canowindra. 

A previous community committee which had managed the building had become inactive and as a result power had been disconnected. 

With the reconnection of power, it was realised that the air-conditioning unit was not functioning and not suitable for repair.  The building is now used by the local day care group as well as by several community groups but with the cold winter conditions heating was necessary for the ongoing use of this Council facility, especially for the young children.

The cost of the replacement unit is $2,870.

Director of Environmental Services' REPORT

 

Council has received two applications for heritage conservation work as part of the council’s annual heritage grants program.

 

1.   Replacement of awning at 82-86 Gaskill Street, Canowindra restoration The three shops share a single façade, and form part of the heritage conservation area of Gaskill Street as well as being an individual heritage item recorded in schedule 5 of the Cabonne Local Environmental Plan 2012.  The awning requires replacement and maintenance of associated guttering.  building is identified as being in a heritage conservation area.  The proposed works is estimated to cost $7,964.

 

The Heritage Advisor has provided advice to the property owners and is in support of the heritage grant application.  It is recommended that $1,500 be offered by way of a grant to enable repair and conservation worth to these key cluster of shops.  Mr Cullane is the applicant on behalf of three property owners being himself, Ms K Kelly, and IR & DJ Guihot.

 

2.   Site works as initial conservation work to ensure longevity of a century old rural outbuilding contain rare collection of items and materials at 1078 Burrendong Way, Clergate.  The initial stabilisation site works includes construction of swale drains to improve drainage around the round pole and corrugated iron building.  The building is not included in the council’s heritage study however has been inspected by council’s heritage advisor who recommends its inclusion in the state heritage inventory data.  The proposed works are estimated to cost $1,760.

 

The Heritage Advisor has provided advice to the applicant and is in support of the heritage grant application.  It is recommended that $800 be offered to Bonny Campbell, as applicant for the owner Mr RG Culverson, to enable conservation works to be initiated to conserve a rural building.

 

The council supports the conservation of the shire’s heritage and facilitates annually the heritage advisory service and the heritage grants program.  Funds have been allocated in the council budget in association with state funding for the operation of the Cabonne Council’s 2016/2017 heritage grants program.

The following report provides an assessment of the development application 2016/113 submitted for alterations & additions to a dwelling upon Lot 1 DP 395059, land also known as 1815 Long Point Rd, Mullion Creek. 

 

The application has been referred to the Council for determination as the   proposal does not comply with the relevant planning provisions as the existing dwelling was not lawfully erected and constitutes illegal development. 

 

In considering the development proposal for alterations and additions it is recommended that Council refuse the application and acknowledge that Council staff will enact the appropriate orders and notices relating to the illegal works that have already been done.

Section 23A of the Local Government Act ‘Council decision making merger proposal periods’ requires council to consider these guidelines and assess any impact upon a determination.  The guidelines have been considered and the proposed development and determination for support is not contrary to the guidelines.

 

The PROPOSAL

 

Council approval is sought for alterations and additions to the existing dwelling at lot 1 DP 395059 land also known as 1815 Long Point Road, Mullion Creek. 

 

A dwelling exists upon the subject land.  Mapping records indicate the structure was built sometime after 1980 and prior to 2006.  Further additions (substantial) were made to the structure potentially in 2015 (based upon aerial imagery). 

 

Wastewater disposal will be via an onsite septic system (OSSMS) which is yet to be installed.  At present all wastewater (including blackwater) is disposed to a hole in the ground which presents an environmental and health risk. 

 

Access to the site is via Long Point Road (unsealed) and is yet to be constructed.  

 

BACKGROUND

A search of Council records did not find any development applications for any development upon the land.  Therefore, it cannot be conclusively determined if the existing dwelling was lawfully established.  An initial assessment of the building would indicate it was established in the late 1980s to early 1990s.  During this time there were planning provisions in place that would have required development approval for a dwelling upon the land.  Furthermore, a search of the Central Mapping Authority of NSW maps of Kerrs Creek (dated © 1988) did not show the dwelling on the Topographic Map. 

The SITE

 

 

 

MATTERS FOR CONSIDERATION

Section 79C of the Environmental Planning and Assessment Act 1979 requires Council to consider various matters, of which those pertaining to the application are listed below.

 

PROVISIONS OF ANY ENVIRONMENTAL PLANNING INSTRUMENT s79C(1)(a)(i)

 

Clause 1.2  Aims of the Plan

The broad aims of the LEP are as follows:

a)   to encourage development that complements and enhances the unique character and amenity of Cabonne, including its settlements, localities, and rural areas,

 

b)   to provide for a range of development opportunities that contribute to the social, economic and environmental resources of Cabonne in a manner that allows present and future generations to meet their needs by implementing the principles of ecologically sustainable development,

 

c)   to facilitate and encourage sustainable growth and development that achieves the following:

 

i.    contributes to continued economic productivity, including agriculture, business, tourism, industry and other employment opportunities,

ii.   allows for the orderly growth of land uses while minimising conflict between land uses within the relevant zone and land uses within adjoining zones,

iii.  encourages a range of housing choices and densities in planned urban and rural locations that is compatible with the residential and rural environment and meets the diverse needs of the community,

iv.  promotes the integration of land uses and transport to improve access and reduce dependence on private vehicles and travel demand,

v.   protects, enhances and conserves agricultural land and the contributions that agriculture makes to the regional economy,

vi.  avoids or minimises adverse impacts on drinking water catchments to protect and enhance water availability and safety for human consumption,

vii. protects and enhances places and buildings of environmental, archaeological, cultural or heritage significance, including Aboriginal relics and places,

viii. protects and enhances environmentally sensitive areas, ecological systems, and areas that have the potential to contribute to improved environmental, scenic or landscape outcomes.

 

Clause 1.9A Suspension of covenants, agreements and instruments

This clause provided that covenants, agreements or other similar instruments that restrict the carrying out of development upon the subject land do not apply unless such are:

 

·    Covenants imposed or required by council

·    Prescribed instruments under s183A of Crown Lands Act 1989

·    Any conservation agreement under National Parks and Wildlife Act 1974

·    Any trust agreement under the Nature Conservation Trust Act 2003

·    Any property vegetation plan under the Native Vegetation Act 2003

·    Any biobanking agreement under Part 7A of the Threatened Species Conservation Act 1995

·    Any planning agreement made under Division 6 of Part 4 of the Environmental Planning & Assessment Act 1979

Cabonne Local Environmental Plan 2012

The subject land is zoned RU1 Primary Production by the Cabonne Local Environmental Plan 2012.   A dwelling is permissible within this zone, subject to Council’s development consent.

 

Objectives of the RU1 Primary Production zone

The proposal is not contrary to the aims of the LEP or the objectives of the RU1 zone.   The development relates to and is consistent with the zone objectives which seek to

 

·    To encourage sustainable primary industry production by maintaining and enhancing the natural resource base.

·    To encourage diversity in primary industry enterprises and systems appropriate for the area.

·    To minimise the fragmentation and alienation of resource lands.

·    To minimise conflict between land uses within this zone and land uses within adjoining zones.

·    To enable function centres, restaurants or cafes and appropriate forms of tourist and visitor accommodation to be developed in conjunction with agricultural uses.

 

Part 4 – Principal development Standards

Clause 4.2A Dual occupancies and rural dwellings on land on RU1 and RU2 zones

 

4.2A(3) Development consent must not be granted for the erection of a dual occupancy or dwelling house on land to which this clause applies, and on which no dual occupancy or dwelling house has been erected, unless the land:-

 

(a) is a lot that is at least the minimum lot size (100 Ha) shown on the lot size map in relation to the land. 

 

MLS for the RU1 zone is 100 Ha and Lot 1 has a total area of 197.13 hectares.  A dwelling could be permissible upon the land under clause 4.2A(3)(a) subject to seeking development approval from Council. 

 

Part 5 – Miscellaneous provisions

There are no miscellaneous provisions that apply to the proposed development. 

 

Part 6 – Additional local provisions

 

Clause 6.3 Terrestrial biodiversity

The dwelling site is cleared grazing land and no remnant vegetation is required to be removed for the development.  There will be no impact to terrestrial biodiversity as a result of the development proceeding. 

 

Clause 6.8 Essential services

Council is satisfied the following essential services that are essential for the development are available:-

a.   The supply of water

b.   The supply of electricity

c.   The disposal and management of sewerage

d.   Stormwater drainage, &

e.   Suitable vehicle access

 

REGIONAL ENVIRONMENTAL PLANS

 

There are no Regional Environmental Plans that apply to the subject land.

 

STATE ENVIRONMENTAL PLANNING POLICIES

 

Cabonne Council is identified within the SEPP 44 schedule as having koala habitat.   The applicant has not addressed the SEPP; however, the subject land is generally cleared and the proposed development will not impact upon any existing vegetation.   There are no known sightings of koalas in the locality, or sources of koala habitat.

 

PROVISIONS OF ANY DRAFT ENVIRONMENTAL PLANNING INSTRUMENT THAT HAS BEEN PLACED ON EXHIBITION s79C(1)(a)(ii)

 

There are no draft environmental plans that relate to the subject land or proposed development.

 

PROVISIONS OF ANY DEVELOPMENT CONTROL PLAN s79C(1)(a)(iii)

 

Development Control Plan No 5 – General Rural Zones applies to this development.

 

The proposed development complies with Section 3 Building Requirements

 

PROVISIONS PRESCRIBED BY THE REGULATIONS s79C(1)(a)(iv)

The proposal does not contravene the relevant provisions of the regulations.

 

THE LIKELY IMPACTS OF THE DEVELOPMENT s79C(1)(b)

 

Siting & Location

The existing building is sited 28m from a large dam on the property.  It is setback 350m from the vehicle access point on Long Point Road.  It should be noted this does not accurately represent the actual setback from the boundary because this section of Long Point Road is not constructed within the road reserve.  Without an official survey of the land it is not possible to accurately determine if the existing dwelling is constructed on freehold land or within a road reserve.  

 

Visual amenity

External construction materials are non-reflective (galvanized iron roof and wall sheeting).  Also, the building is sited so that there will be no impact to views and privacy of neighbouring properties.  There will be no adverse impact from the development in terms of visual amenity. 

 

Access & traffic

Vehicle access to the site is via a stock gate on Long Point Road (unsealed) and the existing access does not meet Council specifications.  Also, the internal driveway is not constructed to a 2 wheel drive standard.  Draft conditions would need to apply for provision of private access, traffic and pedestrian management plan and internal access should an application for a dwelling be submitted. 

 

 

THE SUITABILITY OF THE SITE s79C(1)(c)

 

Physical Attributes and Hazards

 

The subject land is identified as bushfire prone as per the RFS mapping.  An assessment of the impact of the development has been carried out by Council staff and there are no conditions for protection from bushfire. 

 

DEVELOPMENT CONTRIBUTIONS

Section 94 Bushfire Contribution is are calculated as follows:-  

$597.90 to the Mullion Creek Bushfire Brigade (Medium Category)

Section 94 Road Improvement Contributions is calculated as follows:-

The proposed development is considered to be of minor interest to the wider public due to the relatively localised nature of potential impacts.  

 

CONCLUSION

 

In conclusion the development proposal does not comply with the relevant aims, objectives and provisions of the Cabonne LEP 2012 as the existing dwelling was not lawfully erected and constitutes illegal development.  In considering the development proposal for alterations and additions it is recommended that Council refuse the application and acknowledge that Council staff will enact the appropriate orders and notices for the illegal works that have already been done.

At the Council meeting held 26 July 2016 Council considered Development Application 2016/92 which was recommended for refusal. The Council resolved to defer the Development Application to the next Council meeting for approval, subject to provision of a Draft Notice of Approval.

The draft conditions of consent have been prepared by Council staff and are attached for the Council’s consideration. It is recommended that Council approve the proposed development subject to the attached conditions of consent.   

Section 23A of the Local Government Act ‘Council decision making merger proposal periods’ requires council to consider these guidelines and assess any impact upon a determination.  The guidelines have been considered and the proposed development and determination for support is not contrary to the guidelines.

DRAFT CONDITIONS OF CONSENT

 

1.   DEVELOPMENT IN ACCORDANCE WITH PLANS

 

Objective

 

To ensure the development proceeds in the manner assessed by Council.

 

Performance

 

Development is to take place in accordance with the attached stamped plans (Ref: DA 2016/92 Peter Basha Planning & Development, Ref 15038DA, Sheets 1 to 4, dated 10 December 2015) and documentation submitted with the application and subject to the conditions below, to ensure the development is consistent with Council’s consent. 

 

The Principal Certifying Authority for the project may request an application for modification of this consent or a new application in the event that changes to the approved plans are subsequently made.  An application to modify the development consent under s96 of the Environmental Planning and Assessment Act, 1979, as amended and will be subject to a separate fee.

 

 

2.   BUILDING CODE OF AUSTRALIA 2016 – AUSTRALIAN STANDARDS

 

Objective

 

To satisfy the Building Code of Australia 2016 and relevant Australian Standards.

 

Performance

 

The approved dwelling must meet the relevant Australian Standards and the performance requirements of the Building Code of Australia 2016. Compliance with the Performance Requirements can only be achieved by:-

 

a)      complying with the Deemed to Satisfy Provisions; or

b)      formulating an Alternative Solution which:-

 

          i)        complies with the Performance Requirements; or

          ii)       is shown to be at  least equivalent to the Deemed to Satisfy Provisions; or

          iii)      a combination of both a) and b).

 

 

3.   APPOINTMENT OF PRINCIPAL CERTIFYING AUTHORITY

 

Objective

 

To ensure compliance with s81A of the Environmental Planning and Assessment Act 1979 as amended.

 

Performance

 

The person having the benefit of this consent must appoint a Principal Certifying Authority for the development, pursuant to Section 81A of the Environmental Planning and Assessment Act 1979, as amended and advise Council in writing of that appointment BEFORE WORKS COMMENCE.

 

That Certifying Authority may be the Council, or an Accredited Certifier appointed under the Act.  The required written notice to Council may be satisfied by supplying a copy of the Application for a construction Certificate (Form 11) under the Environmental Planning and Assessment Regulation 1994, as amended and must include the name, contact address, telephone and accreditation numbers of the selected Certifying Authority.

 

The Principal Certifying Authority and any other Certifiers appointed by that Authority will be responsible for the post-consent certification of the development.  Copies of all certification is to be submitted to Cabonne Council referenced by the Development Application Number.

 

 

4.   APPLICATION FOR CERTIFICATION

 

Objective

 

To satisfy the post-consent requirements of this Development Consent, and to comply with S.109 of the Environmental Planning and Assessment Act 1979, as amended.

 

Performance

 

The person having the benefit of this consent is required to apply for the following:-

 

CONSTRUCTION CERTIFICATE, and

OCCUPATION CERTIFICATE.

 

5.   STORMWATER

 

Objective

 

To ensure satisfactory disposal of roof stormwater run-off.

 

Performance

 

All roofwater shall be collected through guttering and downpiping, connected to a 100mm or 90mm PVC pipeline and shall be disposed of:-

 

1.       3m away from the building,

2.       to the existing storm water drainage system,

3.         well clear of the effluent absorption area to prevent infiltration or runoff to the area, or

4.         convey all roof rainwater to an approved absorption / rubble trench, having a cross-sectional area of 600 mm x 600 mm and being one (1) metre long for every 25m2 of roof area drained thereto.  Trenches are to be located three (3) metres clear of any Building or Lot boundary and not in a position to permit infiltration or overland flow to an effluent disposal area.

 

 

6.   SOIL EROSION

 

Objective

 

To protect the water catchments.

 

Performance

 

Provide and maintain a silt intercept fence along the lower boundary of the site or as otherwise directed by the Council to ensure that silt does not enter the stormwater system/catchment.

 

 

7.   NOISE

 

Objective

 

To limit the impact of noise on adjoining properties.

 

Performance

 

Building work may only be carried out on the site between the following hours:

 

7.00am and 6.00pm Monday to Friday

8.00am and 1.00pm Saturdays

No work is to be carried out on Sundays or Public Holidays. This includes site works and deliveries.

 

 

8.   IDENTIFICATION OF SITE

 

Objective

 

To clearly identify the site.

 

Performance

 

Provide a clearly visible sign to the site stating:-

a)   Unauthorised entry is prohibited

b)   Builders name and license number; or owner builders permit number;

c)   Street number or lot number;

d)   Contact telephone number/after hours number;

e)   Identification of Principal Certifying Authority.

 

 

 

9.   BASIX CERTIFICATE

 

Objective

 

To ensure the dwelling is constructed in the approved manner.

 

Performance

 

All the required commitments shown on the Basix Certificate (No: 693462S, dated 17 December 2015) and approved plans are to be completed PRIOR to a Final Occupation Certificate being issued.

 

10. WATER SUPPLY

 

Objective

 

To ensure provision is made for adequate rural water supply.

 

Performance

 

In rural areas (where town water is not available)

 

a.   Storage facilities for at least 90,000 litres of water for domestic purposes are to be provided, 20,000 litres of which are to be retained at all times for fire fighting purposes; or

 

b.   The 90,000 litres storage facilities may be reduced to 45,000 litres where an alternative acceptable potable water supply source is available, capable of delivering at least 1,300 litres per hour. Separate application is to be made to the Consent Authority – Cabonne Council.

 

c.   The water supply tanks are required to have, for bush fire fighting requirements, openings in the top of the storage for drafting water or an approved suitable outlet and access to the storage for conventional fire fighting suction hose.

 

The take off point for the domestic supply is to be located in such manner to ensure that the 20,000 litres of water is retained at all times for bushfire fighting purposes.

 

1.   The outlet for fire fighting purposes shall be fitted with 65 mm STORZ fitting and 65mm gate valve, and

 

2.   The outlet for (1) above shall be located so that access for fire fighting units is provided, ie directly where there is vehicle access to the outlet or via plumbing where such direct access is not possible.

 

 

11. CONTRIBUTION TO BUSHFIRE SERVICES (Rural Dwellings)

 

Objective

 

To make an equitable contribution towards improvement of Bushfire Services and Amenities for the specified Brigade. The contribution has been levied in accordance with Councils Bushfire Service Contributions Plan, February, 1993.

 

A copy of this Plan is available for inspection at Councils Department of Environmental Services Bank Street, Molong during business hours.

 

Performance

 

The applicant will make a contribution of $382.70 towards the improvement of Bushfire Services and Amenities for North West Brigade (Income No: 1029) to Cabonne Council prior to any Occupation Certificate being issued for the dwelling.

 

12. INTERNAL ACCESS

 

Objective

 

To ensure a satisfactory all weather access is available to the new dwelling site.

 

Performance

 

Prior to issue of any Occupation Certificate, the applicant is required to upgrade/construct an internal road from the point of access to Lot 1 DP 878304 to the proposed new dwelling house to a standard that allows access by a typical 2-wheel drive vehicle in wet weather, at the applicants cost.

 

 

13. OCCUPATION CERTIFICATE

 

Objective

 

To ensure compliance with the Environmental Planning & Assessment Act 1979.

 

Performance

 

All buildings will require an Occupation Certificate PRIOR to occupation/use of the building.

Council’s investments as at 31 July 2016 stand at a total of $42,071,579.

 

Council’s average interest rate for the month was 2.72%.   The effect of the low cash rate is having a negative impact on term deposit rates offered by financial institutions.  The Reserve Bank’s official cash rate remained at a  record low of 1.75% for the month of July.   However, Council’s average rate is higher than Council’s benchmark rate of the 30 Day Bank Bill Swap Rate of 1.86%. 

 

Council’s investments are held with multiple Australian financial Institutions with varying credit ratings according to Council’s Investment Policy.  The annexure attached to this report shows a break up of each individual institution that Council invests with and its “Standard and Poors” Credit Rating.

 

The Schedule of Investments for July 2017 is attached for Council’s information.

Council adopted guidelines for the Community Facilitation Fund (CFF) in March 2015.  The CFF was created for smaller community projects not originally included in the council’s budget, to be allocated at the discretion of the Mayor and Deputy Mayor.

 

As a reminder, the guidelines for the CFF are as follows:

 

1.   Projects where no existing vote for the works has been allocated or the vote is insufficient to complete the project.

 

2.   Recipients must be community based not-for-profit groups.

 

3.   Mayor and Deputy Mayor to jointly approve funds (with the General Manager as proxy if one is not available).

 

4.   Allocation of funds to be reported to the next available council meeting.

 

5.   Limit of $3,000 per allocation unless other approved by council.

Community Services Manager's REPORT

 

There are a variety of models of aged accommodation in Cabonne.  This includes hostels and nursing homes, Multipurpose Health Facilities, resident funded aged units and rental units for those unable to afford an accommodation bond.

 

The main providers of accommodation are the UPA, Salvation Army, Western NSW Local Health District, Manildra Lions Club, Housing Plus, Molong Yarn Market and Council.  In addition to this the Canowindra Retirement Village Committee is proposing to construct a number of self care units.

·    UPA services at Yeoval include Hazelholme Hostel, Yeoval Community Nursing Home, and a Community Aged Care Programme.  

 

UPA Molong

·    UPA services at Molong include Molong Lodge Self Care Units, Prunus Lodge Hostel and some Community Aged Care Packages.

·    The resident’s rooms at Prunus Lodge are currently being refurbished and extensions to the building will provide activity areas and a pain clinic. 

·    There are 22 Molong Lodge retirement units which operate on a resident funded model with residents paying a substantial bond to be accommodated.  This bond is largely refunded when the units are vacated and there is a fortnightly maintenance charge to cover the upkeep of the units.

 

Western NSW Local Health District

·    The Western NSW Local Health District operates Multi Purpose Services at Eugowra and Molong.  The creation of the Multipurpose Services has enabled Australian Government funding to be utilized to assist people who need residential aged care type accommodation. 

·    Reconstruction of facilities at Molong Hospital will enhance the multipurpose service, increase existing residential aged care room sizes and create a homelier atmosphere for residents.

·    Eugowra Multi Purpose Service offers permanent and respite aged care beds, a day centre, physiotherapist, visiting allied health services, community health nursing, walk in health services and a community exercise program.

·    The changing models of care have led to more flexible service models being developed which are more client-focussed, responsive to the community’s needs, and offer better integration of services.

·    MPSs offer opportunities to integrate a range of health services, including acute care, subacute care (including respite and palliative care), emergency,

·    Allied health, oral health, primary health and community services.

 

Manildra Lions Club

·    Currently has 11 self care aged units and one 3 bedroom cottage.  A further two, 2 bedroom prefabricated units are about to be installed with this being made possible through a bequest received by the club.  The residents pay a weekly rent and there is no upfront charge.  The club would like to attract some more younger members.

 

Molong Yarn Market

·    Molong Yarn Market has seven self-contained units for older people.  There is a small upfront entrance charge and a weekly maintenance fee.

 

Acacia Lodge / Boree Lodge

·    A s.355 committee has been delegated the care control and management of the Acacia and Boree Lodge Units.  These units are available on a discounted fortnightly rent and aim to house those aged people who are unable to pay an entrance bond.

·    There are three two bedroom units and two 3 bedroom cottages at Molong and four self-contained units at Cudal managed by this committee.

·    One of the three bedroom houses is for sale to help fund the construction of a further three 2 bedroom units in Edward Street Molong.

 

Moyne Aged Care Plus

·    The Salvation Army runs the Moyne Aged Care Plus nursing home and Hostel at Canowindra.  There are 63 beds in their complex catering for a variety of needs and they currently have ten vacancies they wish to fill.  They offer a range of people centered programs and have nursing staff in attendance 24 hours a day.

 

Canowindra Retirement Village

·    The Canowindra Retirement Village Committee have been actively working towards the construction of up to 14 aged care units at Canowindra for many years.  Council has assisted them in purchasing the site for the units and ongoing support towards their project is being provided. 

·    There is a meeting scheduled with Council staff to assist the committee further.

·    The Canowindra Retirement Village is proposed to operate on a resident funded model and is hoping to interest a major aged care provider in funding and running the units.

 

Eugowra Retirement Village

·    Eugowra Retirement Village is managed by a s.356 committee of Council.  It has five 1 bedroom units in Nanima Street Eugowra.

·    The units have been mildly flood effected once in the past 20 years.  The committee has raised some funds and would like to construct additional units on higher ground.  The existing units were constructed from local fundraising efforts and a grant from Housing NSW.

·    The committee have a long term plan to expand and is seeking a suitable site for expansion.

 

From the above there is a wide range of accommodation for older people in Cabonne and this area has been successful in attracting many retirees to live locally.  The close proximity to high quality health services is a significant factor in this. 

 

Council’s support of its communities through provision of aged services and improving the accessibility of its communities helps to make Cabonne an attractive place for older people to live.

The Wine of the Month for August is Orange Mountain Wines – 2016 Sauvignon Blanc.

 

Orange Mountain Wines vineyard was planted in 1997 and established the wine label in 2000.  The vineyard has been awarded many national and international medals and trophies. 

 

What’s On In Cabonne Newsletter

The Cabonne ‘What’s On’ Newsletter promoted 21 events and activities in August.  The newsletter is distributed widely via email to regional Visitors Centres, Cabonne tourism operators, accommodation providers, schools, progress associations, community groups, regional and local media, posted on the Cabonne Council and Cabonne Country websites and Facebook pages, with 350 hard copies distributed throughout the shire.

Orange Region Tourism Workshop

 

Orange Region Tourism Workshop was held on Thursday, 4 August 2016 at the Canobolas Hotel in the ballroom.  The workshop was facilitated by Bob Campbell and Lynda Jones who kept the 100 attendees involved and working through the various tourism planning issues and guiding discussion to explore the future of tourism for the region.

 

The workshop was opened officially by Orange Mayor John Davis.  Cabonne Council was represented by Clr Ian Davison, Tourism & Community Development Coordinator Lynne Hawkes and Age of Fishes Museum Manager Warren Keedle.  The workshop was well attended by a diverse industry representation, Destination NSW Candice Torres and Central NSW Tourism Lisa Ditchfield. 

 

Overall the workshop was well run and a worthwhile exercise in attracting diverse industry participation in exploring future tourism and promotional opportunities in planning process for the region.

Signs signifying Canowindra’s status as an RV Friendly town have been installed at four entry points to the town.  Campervan & Motorhome Club of Australia will be promoting Canowindra in their magazine published in September.

The marketing campaign promoting 11 villages of Cabonne completed on the 4 August.  A summary report will be submitted to Council on the 12 August 2016 for Council consideration.

OPERATIONS MANAGER ROADS & BRIDGES' REPORT

Council has recently received correspondence from the NSW Government Ministry for Police and Emergency Services regarding the opportunity to apply for Disaster Assistance funding for the repair of council assets following the recent spate of severe weather events.  

At the time of the submission of the application, Council had identified numerous road locations that had been impacted by the inclement weather.  These include significant pavement damage on Belubula Way, Cullya Road, Rivers Road and Paling Yards Loop.  Additionally, damage to drainage structures has occurred on Belubula Way, Burrawong Road, Reedy Creek Road, and Rivers Road.  Preliminary estimates of the damage were required with the submission.  The total estimated damage has been assessed as $430,100. 

Council has not yet been advised whether the application is or will be successful, as the department is compiling applications from other stakeholders.  Council is still awaiting advice regarding the announcement by the government of a natural disaster declaration.

STATE ROADS

Maintenance works have been undertaken due to consistent rain to repair potholes on all State Roads.  The Capital Works programme are yet to commence.

REGIONAL ROADS.

Hanover Creek Bridge

All the structural components (piers, abutments, headstocks and bridge deck) of the bridge are completed. At present, Council is preparing the base for the approach slabs each 3m in length on either side of the bridge approach.  It is anticipated to complete the concrete approach slabs by mid August (weather permitting). 

The new approach roads to the bridge, Council are undertaking the earthworks (cut/fil), and after proper curing of the concrete approach slabs, Council will restart cut/fill earthworks. 

The remaining works are some cut/fill earthworks, in-situ stabilisation, sprayed seal and guardrails.  It is expected to complete the new approach roads by the end of October 2016 (weather permitting).

 

LOCAL ROADS

Gumble Road Sealing

Works have commenced on the 3km third section of Gumble Road Sealing.  This includes the cut and fill and raising of the culverts.

 

Cargo Road Overtaking Lanes

Vegetation has been completed on Biggin Hill Overtaking Lane, Cargo Road.  The roadworks will commence in late December at both overtaking lane locations.

 

Cadia Heavy Patching

Cadia Road Heavy Patching reworks have been completed.

Canobolas Road

The pavement rehabilitation and culvert extensions will be completed mid August, 1.1km by 8m wide formation.

Cullya Road

Heavy Patching and drainage improvements have been completed.

Maintenance Grading

Maintenance works have been undertaken on Stapletons Road, Shades Creek Road, Garra Cemetery Road, Norah Creek Road, Burgoon Road, Pratten Road, Greenbah Creek Road, Gundong Road, Gullengamble Road, Reids Road, Reedy Creek Road, Mandagery Road, Taylors Road, Mousehole Lande, South Bowan Park Road, Kent Road, White Rocks Road, Gordon Road.

KERB AND GUTTERING

The continuation of kerb and guttering in McLaughlin Street has been completed.

CUDAL DRAINAGE IMPROVEMENTS

Works are being undertaken by Council’s contractor to install drainage pipes at Wall and Main Street intersection.  These works will take approximately two weeks and will improve the stormwater drainage in the area.

NOXIOUS WEEDS DEPARTMENT

Work carried out since the last report.

Inspections and Reinspections have been carried out in the areas of Molong, Canowindra and Baldry.

Recent wide spread rain has hindered property inspections.

Inspections of Travelling stock reserves is currently being carried out.

Control work on Council land

Control work on African Love Grass, Chilean Needle Grass, Serrated Tussock and African Boxthorn.

Weed staff are currently carrying out vegetation control around cemeteries headstones and also spraying broadleaf weeds in the cemeteries.                                       

Spraying of roadside shoulders on all bitumen roads has commenced and this will continue for the next two months
