Recommendation

 

THAT Council authorise the signing and affixing of the Common Seal to:

 

1.      The Lease between Talbri Pty Limited and Cabonne Council for Lot 200 DP 1198313.

2.      Annexure "A" referred to in the Lease between Talbri Pty Limited (the "Lessor") and Cabonne Council (the "Lessee").

 

Director of Finance and Corporate Services' REPORT

 

Council received a report in February 2010 advising of the need to relocate the Byng/Emu Swamp Rural Fire Brigade Station following the expiration of the lease and landholder not being prepared to renew.   Council was advised that a local landholder had offered a parcel of land to Council by way of a 99 year lease for the building of the new brigade area.

 

Council at is February 2010 meeting resolved:

 

“THAT Council enter into a lease with Talbri Pty Ltd for a 99 year lease to enable construction of a new Byng/Emu Swamp Rural Fire Brigade Station”.

 

The lease has now been finalised with the terms as follows:

 

TERM:                          99 years

ANNUAL RENT:        One dollar ($1.00) plus GST

USE OF THE

PREMISES:                The Lessee may use the Premises as a fire brigade                                         station and community room

PUBLIC LIABILITY

INSURANCE:             Twenty million dollars ($20,000,000)

LESSOR:                    Talbri Pty Limited

LESSEE:                     Cabonne Council

 

It is necessary to formally execute the lease documents.
