At its Extraordinary Meeting held 5 September 2011 Council resolved:

 

‘THAT Council advertise its intention to pass the following resolution:-

 

THAT Council apply to the Minister for Local Government for approval to abolish wards in the Cabonne Council area’

 

In accordance with Section 210B of the Local Government Act, 1993 advertisements were placed in the following publications for 42 days with submissions closing at 5pm on Monday, 24th October, 2011:

 

·    Central Western Daily

·    Canowindra Pheonix

·    Canowindra News

·    Cumnock Progress Review

·    Cudal News

·    Manildra Matters

·    Molong Express

 

Flyers advising of Council’s resolution and stating the cases for and against wards were placed in all Council offices and village post offices as well as Cargo Store, Canowindra Library, Eugowra Supermarket, Manildra Library, Manildra store and Lou’s Café and Newsagency, Cumnock, as well as the Central West Business Enterprise Centre.

 

The issue receive widespread media coverage with stories on WIN TV, Prime TV, ABC Radio, 2GZ, Radio 105.1, 2EL, Radio 1089, 2PK and most newspapers within the Shire.

 

The matter was also discussed at the Cargo, Mullion Creek, Eugowra, Manildra and Cumnock community consultation meetings as well as being listed on Council’s website.

 

At the close of advertising 6 submissions were received, with a further submission being received the day after closing. All submissions are attached with suggested comments as listed below.

Statement in favour of proposal

 

Eugowra Promotion & Progress Association

Appears more based on concerns regarding representation for Eugowra than the actual proposal to abolish wards. In speaking with the author of the submission at the Eugowra Community Consultation Meeting he expressed his opinion that wards should be abolished but concerns remained regarding representation for Eugowra area into the future.

 

Jill Sands

Supporting abolition of wards with arguments in favour of such a proposal and suggesting that such a move could lead to greater cohesion within Council and overall improved representation for the area.

 

Stirling Butchard

Statement of objection to the abolition of wards

 

R N Cassell

Objection to abolition of wards. Expresses concern at loss of local representation. There is no evidence to support the arguments put forward that concerns raised would necessarily eventuate due to the abolition of ward boundaries.

 

Jack & Debbie Barnes

Opposition to proposal. Comments regarding not receiving a ‘fair go.’ Difficult to support this as a valid outcome as a result of abolition of wards.

 

Jessie Legge

Concerns expressed could be the same with ward boundaries and hopefully would be addressed by proportional representation.

 

 

As previously indicated the ward boundaries for Cabonne are due for redistribution should Council determine not to proceed with a request to the Minister for abolition of ward boundaries. The proposed map that has been previously presented to Council indicates that there would be a distortion of the representation within the shire area due to the need to comply with both the requirements of having contiguous census collection districts while at the same time maintaining the 10% maximum variation between wards.

 

Accordingly it is recommended that Council proceed to pass the resolution as advertised.

Director of Finance and Corporate Services' REPORT

 

This report is provided as a procedural requirement should Council determine not to resolve to abolish ward boundaries. Should the Council to determine to proceed with the recommendation to apply to the Minister for Local Government for approval to abolish wards in the Cabonne Council area then this report would only require notation.

 

Advice has been received from the Electoral Commission of NSW that where a council proposes to amend ward boundaries as required by sections 210 and 211 of the Local Government Act that notification of new boundaries must occur by the 30th December, 2011 to enable both the Electoral Commission of NSW and the Australian Electoral Commission to code electors in the revised ward.

 

Due to the advertising requirements in relation to alteration of ward boundaries it would be necessary for Council to adopt revised ward boundaries at the Extraordinary meeting to be held on the 7th November, 2011 to enable all the statutory provisions to be met.

 

Accordingly attached to this report is the proposed revised ward boundaries for six new wards as previously discussed by Council.

 

 

Recommendation

 

THAT should Council determine not to proceed with the request for the abolition of ward boundaries then the draft six ward boundary proposal be placed on exhibition as required by section 210A of the Local Government Act 1993.
