A Rescission Motion has been received from Clrs Gosper, Dean, Dowling, Durkin, MacSmith, Walker & Wilcox reading as follows:-

 

THAT the recommendation for Item 13 of the Ordinary Meeting of Council held on 15th August be rescinded, and:

 

“THAT Council hold a workshop in conjunction with an Extraordinary meeting to discuss Local Government Act amendments in relation to a reduction in the number of Councillors and the abolition of wards allowing Council to seek Community input.”

Item 13 of the Ordinary  meeting held on 15 August 2011 read as follows:

 

THAT Council:

 

1.   Advertise its intention to request the Minister for Local Government to reduce the number of Councillors from 12 to 9 and to abolish wards for Cabonne Council.

2.   Hold a workshop to develop a case for presenting the above to the community.

 

In order for it to be dealt with by the Council it will need to be moved and seconded on the meeting day.

It was reported to the August Council meeting that amendments to the Local Government Act, enable Council to reduce the number of Councillors without a Constitutional Referendum up to a final date of 28 November 2011.  To enable this to occur, the procedure is as follows:

 

 

·    The Council must give not less than 42 days public notice of its proposal to resolve to apply to the Minister for approval to reduce its Councillor numbers;

 

·    The public notice must;

 

o State the place at which, the dates on which, and the times during which the public may inspect the proposed resolution and;

o Invite public submissions on the proposal;

 

·    The Council must bring the notice to the attention of as many people in its area as possible. This is commonly done by doing all of the following;

 

o Advertising in a newspaper regularly circulating in the Council area

o Exhibiting the notice in public areas such as community centres, libraries and public notice boards; and

o Posting the notice on the Council’s website

 

·    After passing the resolution Council must forward to the Minister;

 

o A copy of the resolution

o A summary of any submissions received by it; and

o Its comments concerning those submissions

 

Councils are reminded that Section 224A still prevents such applications being made where;

 

·    The reduction would result in the Council having less than five Councillors

·    The Council is divided into Wards and the reduction would result in the number of Councillors for each Ward being fewer than three (subject to the number of Wards).

 

Further, as was the case before the amendment;

 

·    Where a Council receives approval to reduce the amount of Councillors, the reduction will not take place until the next Ordinary Election, however;

 

o By reason of section 294A of the Act any casual vacancies that occur during this period will not be required to be filled unless the number of councillors on the Council would become less than the reduced number approved by the Minister.

 

Should Council determine to reduce Councillor numbers, it would need to pass the recommendation as printed, or with an amended Councillor number.

 

 

Recommendation

 

THAT Council advertise its intention to pass the following resolutions: -

 

“THAT Council apply to the Minister of Local Government for approval to reduce the number of Councillors from 12 to 9 for the Cabonne Council.”

ITEM 9 - EUGOWRA DIGITAL TV TRANSMISSION

REPORT IN BRIEF

 

Reason For Report

Inform Council of the proposed commercial digital TV transmission from the Round Hill tower and need to undertake minor works at the site to accommodate new communications infrastructure.

Director of Engineering and Technical Services' REPORT

Council may recall a report to the June 2011 Ordinary Meeting advising of the discontinuation of Council’s Analogue TV transmission licence and the possible upgrade to Digital service at Eugowra.

A representative of BTS Networks Pty Ltd met with Council’s Director of Engineering and Technical Services and Cr David Hyde at the transmission site to discuss the upgrade for Digital TV transmission. BTS has been contracted by Regional Broadcasting Australia (a group of regional television broadcasters) to complete the delivery of Regional Digital Television to small local communities in regional Australia.

While Council has not received a formal letter of offer for the digital service, the visit from BTS signifies Eugowra is to be upgraded to digital. The BTS technician was very complementary of the existing facility and indicated only minimal works would be required to accommodate the new communications infrastructure.

The upgrade works council would be required to undertake include;

·    Provision of additional power outlets in the hut. Note the existing power supply is adequate.

·    Provision of an air conditioning unit. The specifications to be provide by BTS.

·    Covering of ventilation points to make insect proof.

The transmission hut and tower is located on private land. Currently access is provided by way of an agreement between the Eugowra Progress and Promotion Association and the landowner.  For ongoing access, BTS ask that the existing access arrangements be maintained going forward. Council will be required to enter into an agreement with BTS that establishes the term, rental fee and responsibilities.

It should also be noted that due to an administrative anomaly, Essential Energy have not been reading the metre box, arrangements are in place to correct this. Council will be required to meet the power costs, however this is considered to be minimal.

 

Recommendation

THAT Council:

1.   Note the report for digital TV service for Eugowra.

2.   Approve the up-grade works

3.   Delegate to the General Manager authority to sign the commercial terms of agreement.
