Clause 240(4) of the Local Government (General) Regulation 2005 requires Council to refer any business to be considered when the meeting is closed to the public in the Ordinary Business Paper prepared for the same meeting.  Council will discuss the following items under the terms of the Local Government Act 1993 Section 10A(2), as follows:

 

ITEM 16    BUSINESS DEVELOPMENT ASSISTANCE

(c) information that would, if disclosed, confer a commercial advantage on a person with whom the Council is conducting (or proposes to conduct) business

Administration Manager's REPORT

 

At Council’s June Meeting the question of why annexures to some Environmental Services’ Development Application (DA) Notation reports are being treated as confidential was raised.

 

These include “Development Applications Approved During the Preceding Month” and “Development Applications Received During the Preceding Month”.

 

Originally reports provided Lot and DP details only however councillors requested the name and street address details which under the then relevant Privacy legislation prompted the confidential annexures.

 

The ‘DAs Received’ reports allowed councillors to familiarise themselves with upcoming developments and to provide early notice for Councillors to be able to declare an interest if appropriate when a particular DA comes before Council.

 

After a review of relevant legislation and observation of other Councils’ processes it is considered that the information contained in these annexures is now publicly available in any case and there is no need for these annexures to continue to be treated as confidential.  It should be noted that the GIPA Act requires copies of all DAs and associated documents to be posted on Council’s website.

 

Accordingly these annexures will not be treated as confidential as of the August 2010 Council meeting.

THAT these annexures not be treated as confidential as of the August 2010 Council meeting..

 

 

ITEM 33 - Item 23 Works Committee Report, Supplementary information for Item 4 RLCIP

Director of Engineering and Technical Services' REPORT

Item 4 of the August Works Committee dealt with round 3 of the RLCIP and  included a schedule of projects to be completed from the program. The minutes from the meeting do not mention the projects nominated for Cumnock.

 The projects nominated are:

1.   Provision of a community sign and seating.               $10,000

2.   Construction of a quarter basketball court and hoop.         $10,000

It is also noted that the schedule listed Mullion Creek Walkway as a RLCIP project. This should read Ophir Reserve Causeway cycle/walk path.

Item 5 of the August Works Committee dealt with the LAIP (2010/11 budget) and included a schedule of projects to be considered by the Committee. Included in the schedule was an allocation of $20,000 for Ophir Reserve Causeway. This was removed from the LAIP list and added to the RLCIP program.

 

Recommendation

 

THAT the above amendments be adopted in conjunction with the recommendations of the report of the Works Committee held on 2 August 2010.
